Prosecution for Breach of Licence

Maurice Sines the owner and licence holder of Breach Barns Mobile Home Park, Waltham Abbey, was prosecuted by Epping Forest District Council on 6 June 2008 at Epping Magistrates’ Court for breach of the conditions of the site licence. The Magistrates fined Mr Sines £500, a Victim Surcharge of £15 and ordered him to pay the Council’s prosecution costs of £227.

A new double unit mobile home had been positioned at the location of 7 The Rise Breach Barns in contravention of the Site Licence. This mobile home was too close to two other mobile homes on the site and an adjacent roadway. No application had been made to the Council to reduce the distances for this home as was possible in the Licence conditions.

On 10 January 2008 Officers from Epping Forest District Council verified the measurements were too small. They visited again on 7 February with Essex Fire Officers who agreed with the Council’s findings and were of the opinion that due to the closeness of the homes the risk of a fire spreading from home to home was increased.
