Chigwell Parish Council neighbourhood plan

Current status

Following submission, the Chigwell Parish Council draft neighbourhood plan has now been considered by an independent examiner who provided his report on 5 November 2018. The examiner has concluded that as a whole, the plan does not meet the basic conditions required of a neighbourhood plan and therefore cannot recommend that the plan should proceed to referendum.

A copy of the examiner’s report is attached. The examiner’s report was considered at the EFDC cabinet meeting held on 7 February 2019 where the council agreed with the examiner that the neighbourhood plan proposal should be refused and therefore not proceed to the referendum stage. A copy of the council’s decision statement issued following the cabinet meeting is attached.

Regulation 16 publication

In accordance with Regulation 16 of the Neighbourhood Planning (General) Regulations 2012, Epping Forest District Council is now publicising Chigwell neighbourhood plan. Representations received under regulation 16 regarding the plan proposal will be forwarded to an appointed examiner, who will assess the plan proposal and supporting documents against 7 basic conditions. The publication period of the plan proposal is between 12 noon on Tuesday 15 May and 4pm on Tuesday 26 June 2018. Please note that Natural England has provided initial comments to the emerging Chigwell neighbourhood plan and the associated habitat regulation assessment.

Approval of the area application

Following the close of the 8-week consultation period, Epping Forest District Council considered all the comments received and prepared a report and recommendation to take to cabinet on 3 March 2014, where the neighbourhood plan area application has now been approved as a neighbourhood plan area. To comply with Regulation 7 of the Neighbourhood Planning (General) Regulations 2012, Epping Forest District Council is publicising the following details

  • The name of the neighbourhood area: Chigwell neighbourhood area
  • The name of the relevant body who applied for the designation: Chigwell Parish Council

The application and a letter explaining why Chigwell Parish Council intends to prepare a neighbourhood plan, and how the organisation and area meet the conditions of Section 61G(3), (4), (7) and 61H(1) of the Town and Country Planning Act, 1990 can be viewed above.

In accordance with Regulation 6 of the Neighbourhood Planning (General) Regulations 2012 Epping Forest District Council consulted residents and other interested stakeholders on this application. The consultation ran for an 8-week period, in order to allow for the Christmas period, commencing from Monday 16 December 2013 to 10 February 2014. This was not a consultation on the neighbourhood plan itself, only the identification of the area for which the parish or town council wished to prepare a neighbourhood development plan.
